Terms and Conditions for SendxjaPackage Forwarding Company

  • 1. Services Provided:

    Sendxja acts as a package forwarding company, providing international shipping services to customers worldwide. We receive, consolidate, and forward packages on behalf of our customers to their designated shipping address.

  • 2. Customer Responsibility:

    1. Accurate Information: It's your responsibility to provide accurate and complete information when registering with Sendxja, including your name, shipping address, and contact details. Any errors in the provided information leading to delivery issues are solely your responsibility.
       
    2. Prohibited Items: You agree not to ship any illegal, prohibited, or dangerous items through Sendxja. It is your responsibility to familiarize yourself with the list of prohibited items and comply with all local and international shipping regulations. Sendxja reserves the right to refuse any package based on its content.
       
    3. Package Inspections: Sendxja reserves the right to inspect packages received on behalf of customers for security, compliance, or any other necessary purpose. By using our services, you consent to the inspection of your packages.
  • 2.A Customer Responsibility for Legal Compliance

    2A.1 - Customer Responsibility for Legal Compliance. The Customer is solely responsible for ensuring that all goods shipped to Sendx Jamaica Limited (“Sendxja”) are lawful to:

    • Purchase, possess, and export within the United States; and
    • Import, declare, and clear through Customs in Jamaica.
    • The Customer agrees that all shipments must comply with:
    • Applicable United States federal and state laws;
    • U.S. Customs & Border Protection (CBP) regulations;
    • The Customs Act of Jamaica;
    • Jamaica Customs Agency regulations;
    • All other applicable import, export, trade, and criminal laws.
    • Sendxja does not verify the legality of goods beyond documentation provided and relies on the accuracy of the Customer’s declarations.
       

    2A.2 - Customs Examination, Detention & Forfeiture. The Customer acknowledges that under the Customs Act of Jamaica:

    • All imported goods are subject to Customs examination.
    • Goods may be detained pending verification of value, classification, or compliance.
    • Goods that are improperly declared, prohibited, restricted, or entered contrary to law may be seized or forfeited.
    • Goods not entered for clearance within the statutory time period may be deposited in a Government warehouse (commonly referred to as the Queen’s Warehouse).
    • Goods remaining uncleared within the legally prescribed period may be disposed of in accordance with the Customs Act.
    • Sendxja shall not be liable for any detention, delay, seizure, forfeiture, storage, disposal, or auction carried out by Customs or any government authority.
       

    2A.3 - Accuracy of Documentation. The Customer warrants that:

    • All invoices and receipts submitted are genuine and accurate.
    • The declared value reflects the true transaction value.
    • The description of goods is complete and correct.
    • Any misdeclaration, undervaluation, concealment, or false documentation may result in Customs penalties and may constitute a breach of these Terms.
       

    2A.4 - Indemnification. The Customer agrees to indemnify and hold harmless Sendx Jamaica Limited, its directors, officers, managers, employees, and agents from any losses, penalties, fines, liabilities, legal costs, storage charges, or expenses arising from:

    • The unlawful nature of goods shipped;
    • Inaccurate or false declarations;
    • Violations of customs or trade laws;
    • Government enforcement actions related to the Customer’s shipment.
    • This indemnity applies to the extent permitted by law and survives termination of services.
       

    2A.5 - Right to Refuse or Report. Sendxja reserves the right to:

    • Refuse to ship any item reasonably believed to be prohibited or restricted;
    • Request additional documentation where required;
    • Cooperate with Customs or law enforcement authorities as required by law;
    • Suspend or terminate accounts where violations occur.
       

    2A.6 - Limitation of Responsibility. Sendxja operates as a freight forwarder and logistics provider and does not act as the importer of record unless expressly agreed in writing. The Customer remains the beneficial owner of goods and is legally responsible for compliance with import laws.

  • 3. Package Handling and Storage:

    1. Package Storage: Sendxja provides free package storage for up to 14 days from the receipt of each package. After 14 days, a storage fee of $50 per day will be applied for each additional day the package is stored, unless agreed upon otherwise.

    2. Liability for Loss or Damage: Sendxja takes utmost care when handling and storing packages. However, we are not liable for any loss, damage, or theft of packages while in transit to our warehouse.
  • 4. Charges and Payments:

    1. Shipping Charges: Sendxja charges customers for international shipping based on the weight,of each package. Shipping rates are calculated using standard industry practices.

    2. Service Fees: In addition to shipping charges, Sendxja may apply service fees for additional services, such as package delivery, storage, or special handling requests. These fees will be clearly communicated during the shipping process.

    3. Payment Policy: Payment for shipping charges, service fees, and any applicable taxes(customs duties ) are due in full before the packages are shipped. Sendxja accepts various payment methods, as specified on our website.

  • 5. Customs, Duties, and Taxes:

    1. Customs Declarations: Sendxja will facilitate customs declarations for shipments. However, it is your responsibility to provide accurate information and bear any additional customs duties, taxes, or fees imposed upon landing.

    2. Undervaluation: Sendxja strictly prohibits any attempts to undervalue packages for customs purposes. We will declare the actual value of the contents of each package, as described by the customer.
  • 6. Confidentiality and Privacy:

    Sendxja maintains strict confidentiality and privacy practices to protect customer information. We will not share your personal information with third parties, except as required by law or as necessary for providing the requested services. For more information, please refer to our Privacy Policy.

  • 7. Termination:

    Sendxja reserves the right to terminate or suspend your account and access to our services at any time, with or without cause. You may also terminate your account by providing us with written notice. Upon termination, any packages in our possession will be handled in accordance with our policies.

  • 8. Modifications to Terms:

    Sendxja may update or modify these Terms from time to time. Any changes will be effective immediately upon posting on our website. It is your responsibility to review the Terms periodically. By continuing to use Sendxja's services after any modifications, you accept and agree to the revised Terms.

  • 10. Collection of Outstanding Packages

    10.1. Full Clearance Policy: Sendxja requires all customers to collect and settle all previously arrived, outstanding, or unpaid packages on their account before any newly arrived packages can be released.
    Customers cannot pick up one or two packages while leaving older packages uncollected. All packages must be collected in the order they arrive.

    10.2. No Partial Collection: To maintain fairness, warehouse efficiency, and accurate inventory management, customers are not permitted to:
    • Selectively collect certain packages while older packages remain in storage
    • Leave overdue or unpaid packages behind while requesting the release of new items
    • Delay collection of previous shipments to prioritize newer arrivals

    All outstanding packages on the account must be cleared first, without exception.

    10.3. Storage & Abandonment: Packages not collected within the free storage period or packages repeatedly left uncollected may:
    • Accrue storage fees as outlined in Section 3
    • Be considered abandoned after the maximum storage limit is reached
    • Be disposed of, liquidated, or otherwise handled in accordance with Sendxja’s storage and abandonment policies

    Sendxja is not liable for loss, damage, disposal, or delays related to uncollected packages.

    10.4. Customer Responsibility: Customers are responsible for:
    • Monitoring their package arrivals
    • Collecting packages promptly
    • Ensuring all outstanding balances, invoices, and customs-related charges are settled
    • Complying with the Full Clearance Policy prior to pickup

    Failure to adhere to this policy may result in the refusal of package release and may impact continued use of Sendxja’s services.

Missing package policy

Sendxja is committed to transparency and fairness in the handling of all customer shipments. This policy outlines our responsibility in the event a package is reported lost or missing.

  • 1. Services Provided:

    Sendxja acts as a package forwarding company, providing international shipping services to customers worldwide. We receive, consolidate, and forward packages on behalf of our customers to their designated shipping address.

  • 2. Lost Packages (After Confirmed Receipt)

    If a package has been confirmed received by Sendxja and is later deemed lost following an internal investigation, the following resolution applies:

    • Packages Valued Under US$100
    • Sendxja may repurchase the item on behalf of the customer, OR
    • The value may be credited to the customer’s Sendxja account.
    • Credits will be applied to the customer’s account for shipping use.
    • Packages Valued Over US$100
    • A credit note will be issued for the verified value of the item.

    Credit notes are:

    • Non-transferable
    • Not redeemable for cash
    • Usable only toward services provided by Sendxja
  • 3. Claims Process

    To file a lost package claim, customers must provide:

    • Proof of purchase (invoice or receipt)
    • Valid tracking number
    • Delivery confirmation
    • Any additional supporting documentation requested
    • Sendxja reserves the right to investigate all claims thoroughly before approval.

    Investigation period: Up to 30 business days.

  • 4. Exclusions

    Sendxja is not responsible for:

    • Packages not delivered to our official warehouse address
    • Packages not signed for or scanned into our system
    • Customs seizures or government holds
    • Incorrect shipping information provided by the customer
    • Prohibited or restricted items
    • Carrier delivery errors prior to warehouse receipt
  • 5. Fraud Prevention

    Sendxja reserves the right to request verification of item value. False declarations or fraudulent claims may result in:

    • Account suspension
    • Permanent termination
    • Legal action, where applicable
  • 6. Final Determination

    All decisions made by Sendxja management following investigation are final.

Detained & Transferred Goods Policy

This policy outlines the procedures and legal implications when goods are detained and transferred to the Queen’s Warehouse by the Jamaica Customs Agency.

  • 1. Transfer to Queen’s Warehouse

    Goods may be transferred to the Queen’s Warehouse when:

    They are not entered for customs clearance within fourteen (14) days of unloading or deposit.

    Required customs documentation is not provided.

    Duties, taxes, or applicable charges remain unpaid.

    The goods are seized or detained for compliance, regulatory, or security purposes.

    Important Notice:

    All goods held at any other customs-approved warehouse or storage facility that remain uncleared within the legally prescribed period may be transferred to the Queen’s Warehouse for auction in accordance with Jamaican law.

    Once goods are transferred, they are under the sole control and custody of the Jamaica Customs Agency.

    Sendxja has no authority over goods once they are placed in the Queen’s Warehouse.

  • 2. Auction of General Cargo

    Goods stored in the Queen’s Warehouse that are:

    Not entered or cleared within three (3) months, or

    Within such an extended period as directed by the Commissioner,

    May be sold by public auction after one (1) month’s notice published in the Gazette.

    Importers or owners may clear their goods up to the day before the scheduled auction.

  • 3. Perishable Goods

    Perishable goods deposited in the Queen’s Warehouse may be:

    Sold immediately (forthwith) without prior notice by public auction at the discretion of the Commissioner.

  • 4. Non-Perishable Goods Unsuitable for Storage

    Non-perishable goods deemed unsuitable for storage in the Queen’s Warehouse may be:

    Stored at the place of landing or another approved location (constructively warehoused),

    Sold by public auction after fourteen (14) days’ notice published in the Gazette.

  • 5. Application of Auction Proceeds

    Where goods are sold at auction, proceeds are applied in the following order:

    • Duties and taxes
    • Expenses of removal and sale
    • Government rent and storage charges
    • Freight and other applicable charges
    • Any remaining balance

    Any remaining balance may be claimed by the owner within two (2) years from the date of sale. If not claimed within that period, the funds are paid into Jamaica’s Consolidated Fund.

  • 6. Limitation of Liability

    Sendxja Limited:

    • Is not responsible for goods transferred to the Queen’s Warehouse.
    • Is not liable for damage, deterioration, loss, or missing items while goods are in customs custody.
    • Has no control over customs seizure, detention, storage, auction, or disposal decisions.

    Failure to enter and clear goods within the legally required timeframes may result in auction under Jamaican law.
